Family Policy Alliance of Idaho Responds to Magistrate Judge’s “Clarification” in Idaho Birth Certificate Case

The new ruling does not address the constitutional strength of the Idaho Vital Statistics Act (HB509).

BOISE, Idaho – U.S. Magistrate Judge Candy Dale rendered an opinion yesterday clarifying a court order she issued two years ago in a legal battle over the Idaho Department of Health and Welfare’s policy governing the sex marker on birth certificates.

Notably, Judge Dale did not answer “questions concerning the constitutional validity and enforcement” of the Idaho Vital Statistics Act (HB509), which was signed by Governor Brad Little in March.

“The legal battle over the Idaho Vital Statistics Act is far from over. We have confidence that our judicial system will agree that this law is necessary to protect the safety and health of the people of Idaho,” said Blaine Conzatti, Director of Advocacy for Family Policy Alliance of Idaho, a pro-family ministry.

The Idaho Vital Statistics Act protects the integrity of birth certificates – the most important state vital record – by limiting changes to the quantifiable facts that are recorded in birth certificates, including time and place of birth, sex, length and weight. “Birth certificates are records of the facts as they existed at the time of birth. The Idaho Vital Statistics Act ensures that the most important of state vital records are kept factually accurate,” said Conzatti.

“Law enforcement, criminal justice officials, and public health experts need accurate state records to do their jobs well. Allowing individuals to change their birth certificate sex marker to match their subjective feelings instead of biological reality makes it harder for law enforcement to protect vulnerable populations like women and children,” Conzatti concluded.
