One week from today, the U.S. Supreme Court will hear oral arguments in a pivotal abortion case, the first to come before the high court since it struck down Roe v. Wade nearly two years ago.

On March 26th, the Court will take up the issue of abortion pills and the risk they pose to women. Available since 2000, the Food and Drug Administration and, more recently, the Biden Administration, have loosened access to abortion pills over the years.

Originally, abortion pills could only be administered by a doctor during an in-person visit to determine the gestational age of the baby and the health of the mother. In order to safeguard a woman’s health through the medical abortion, the regimen required a second visit 3 days later and a final examination 14 days after that.

In 2016, the FDA eliminated the requirement that doctors provide follow-up visits on the 3rd and 14th days. They also eliminated the requirement that only doctors could prescribe abortion pills.

In 2021, the FDA used COVID to justify radical change these rules again. Shockingly, they removed all in-person examination requirements, permitting abortion pills to be mailed to patients regardless of what state they lived in and what their state laws said about the legality of abortion.

All of these changes put women’s health at greater risk and also further empowered sex abusers and sex traffickers by allowing them to cover up the consequences of their crimes – consequences that are compounded for their victims through medical abortions they experience alone and often with great trauma.

The Court will examine these concerns next week in a lawsuit challenging the FDA rules, brought by a number of pro-life doctors and our friends at Alliance Defending Freedom.

When you hear someone talk about abortion pills, what comes to mind?

Maybe you imagine a woman simply taking a pill similar to headache medicine in a clinical setting, with physicians monitoring and without complications.

Or maybe you know the truth that women are given two pills to take at home – something that, thanks in part to the Biden Administration, can happen without even an in-person medical examination beforehand. One pill will starve the child, and the second will force the child to be expelled from the mother. The woman will likely suffer intense physical symptoms and deliver her aborted child alone at home – often a traumatic experience.

The risk associated with these abortion pills is an astounding four times greater than the risk of surgical abortions. And, increasingly, it’s one of the most common forms of abortion.

But the title of this email said good news – keep reading!

Our friends at Alliance Defending Freedom (ADF) filed a lawsuit on behalf of pro-life doctors. These doctors sued the FDA over the illegal way it approved the abortion pills. According to ADF, “The FDA never studied the safety of the drugs under the labeled conditions of use, ignored the potential impacts of the hormone-blocking regimen on the developing bodies of adolescent girls, disregarded the substantial evidence that chemical abortion drugs cause more complications than surgical abortions, and eliminated necessary safeguards for pregnant girls and women who undergo this dangerous drug regimen.”

So now for the good news: Last week, a federal court in Texas sided with the pro-life doctors, halting the approval of the abortion drugs! This is a major win for protecting both babies in the womb and their mothers. The Biden Administration has appealed this life-saving ruling, and radical abortion associations and Democrats in Congress have gone all in to limit protections for women and support the administration’s efforts to make these dangerous pills widely available. Some have even gone so far as to suggest that the Biden Administration should outright ignore this legitimate, legally binding ruling!

Even as we wait to see what happens next in the Fifth Circuit, here are two things you can do right now to help protect babies:

  1. Speak out: The Biden Administration recently put forward guidance allowing pharmacies to dispense abortion pills. That means that your local CVS or Walmart could turn into an abortion clinic. If you haven’t already, please send a message to pharmacies, asking them not to dispense these pills. It only takes a minute at our Action Center!
  2. Pray: Join us in thanking God for this victory and praying for continued victory as the Biden Administration appeals the decision. This ruling could make its way all the way to the Supreme Court. And, pray with us for the end of abortion, and that life would be truly cherished throughout our nation.

Your action has led to a big pro-life development!!

You may recall that immediately following the New Year holiday the Biden administration announced that it would begin to allow pharmacies to dispense dangerous chemical abortion pills, potentially turning every pharmacy and grocery store into an abortion business – something that had never been done before.

The new guidance would permanently establish a path for doctors to phone-in abortion pills for patients – a very risky and dangerous practice for women in their first trimester of pregnancy.

Since the guidance was released in January, we have been asking our readers to contact some of the largest grocery and pharmacy chains across the nation to share their concerns and to respectfully ask that they not become an abortion business.

As of today, tens of thousands of grassroots messages have been sent, with more coming in every day.

We are excited to share that Walgreens is the first to announce that they will NOT be selling abortion pills or shipping abortion pills to over 20 states – including some where abortion remains legal. This is a direct result of actions by our national coalition and state attorneys general as well as a massive grassroots effort from readers like you.

Walgreens specifically noted that pro-life activism played a role in their decision.

That means that the actions taken by you, our readers, had an impact in this decision.

Already, Walgreens has come under attack from the Left for this decision. California Governor Newsom has stated his intention to cut off any state ties with Walgreens, despite the fact that Walgreens still intends to distribute abortion pills in over half the country. The Left will stop at nothing to undermine the safety and well-being of mothers and their unborn children.

If you took action, thank you – we appreciate your engagement and participation. The battle is far from over, but we press on encouraged by news like this.

It is worth noting that after Roe, pro-life activism has taken on a new and heightened importance.

It is because of the Dobbs decision, that states are now free to protect life like never before and to push back against the Biden administration and corporate America’s proliferation of abortion. Your pro-life voice has more influence in these matters now than it ever had after Roe was handed down in 1973.

This week, the U.S. Food & Drug Administration (FDA) announced it will not enforce a longstanding policy during the COVID-19 pandemic that requires abortion-inducing drugs to be dispensed during an in-person doctor’s visit. In-person appointments are critical to minimize serious health risks to women both before and after an abortion. But, the Biden Administration chose to appease the powerful abortion lobby instead of protecting women.

This announcement is very likely the pre-cursor to a permanent removal of this important safety regulation and others which will put countless women at risk of health complications, including death.

Chemical abortion is big—and risky—business, especially for Planned Parenthood, where chemical abortion makes up 56% of all abortions performed. This is not by accident. Abortion activists have been quietly building a new business model to target young women through their phones and the internet. When safety regulations are loosened – as the FDA has just done – women suffer. Abortion-inducing drugs are four times more dangerous than surgical abortion, and can cause severe infection, heavy bleeding, loss of fertility and even death.

The change in policy at the FDA is just the latest example of the Biden Administration’s anti-woman agenda, which also includes a push to allow men to take women’s places in athletic competitions and to give them access to private women’s spaces like locker rooms, bathrooms and shelters. Fortunately, the states are pushing back on the Administration’s radical social agenda and are making great strides to protect women.

Family Policy Alliance is part of a national coalition of pro-life, pro-woman organizations that has been working across the nation this year to regulate the chemical abortion industry state by state. We realized last year that the federal FDA safety regulations for chemical abortion drugs were at great risk of repeal if a pro-abortion president were elected.  It’s clear that each state must pass protocols to regulate the dispensing and reporting of abortion-inducing pills if women are to be protected long-term.

Already, six states (Arizona, Arkansas, Indiana, Montana, Oklahoma, and Texas) have acted on our coalition’s model legislation to codify the FDA’s longstanding safety regulations, prevent mail-order abortions, and mandate reporting of chemical abortions.  Half of them – Arkansas, Indiana, and Montana – are awaiting their governor’s signature, and several more states are expected to introduce the legislation soon.

As the Biden Administration runs full steam ahead with an anti-woman and anti-life agenda, FPA and our allies will continue to advocate for the rights and safety of women and children in every state.
