BREAKING: Supreme Court Overturns Roe v. Wade

Statement from Craig DeRoche, CEO & President of Family Policy Alliance:

Today is a day that we will remember for our entire lives – and a day which, for many of us, we have spent our entire lives waiting. And now, because of today, millions more will have their lives.

“We’d be remiss not to take this moment to reflect on the many, many heroes who have argued in court, passed laws, lobbied their elected leaders, prayed outside abortion clinics, offered a helping hand to women, and so much more to get to this moment.

“And yet, really, we have been straining toward the starting line. Today, a unique race began in each of the 50 states and in the federal arena.

“Our goal: that every person is treated as a person, no matter their age, size, location, abilities or any other characteristics. This means not only ending abortion but ensuring that children inside the womb have the same full legal status as children outside the womb, that parents and children receive the support they need, and that ours is a culture which comes to fully embrace life.

“As of this moment, America has entered a new phase. We are a nation After Roe. We survived. Now, let’s help others thrive.”

State Breakdown

  • Current outlook across the states:
    • Immediately or very soon, 13 trigger laws will likely go into effect
    • 9 states with abortions bans predating Roe will also likely go back into effect
    • 12 states have heartbeat laws.
    • 4 states have declared no constitutional right to an abortion
    • 16 states (plus D.C.) have an established right to an abortion, either in the laws or by court decisions

  • What happens next:
    • Pro-abortion activists will try to promote abortion through a variety of means including litigation, “right to choose” ballot measures and executive actions, radical abortion legislation (similar to what already exists in some liberal states), and even DIY abortion kits.
    • Pro-life advocates will need to respond to these various attacks from abortion activists.  But, they will also have new opportunities to protect life like never before, going beyond abortion and considering other policy areas to help support parents and children.

Case Information

  • Decision split: Justice Samuel Alito wrote the majority opinion. He is joined by Justices Thomas, Gorsuch, Kavanaugh, and Barrett. Justices Thomas and Kavanaugh authored concurring opinions. Chief Justice Robert concurred in the judgement. Justices Breyer, Kagan, and Sotomayor dissented.
  • Case summary: Mississippi passed a law restricting abortion after 15 weeks of pregnancy. Jackson Women’s Health Organization, a clinic that performs abortions, challenged the law in court. Both sides agreed that Court must either fully overturn or reaffirm Roe in its ruling on the case.
  • About Roe: Roe v. Wade created a supposed constitutional right to an abortion and had the effect of preventing states from fully protecting life.
    • Since Roe, over 62 million people have lost their lives to abortion in America.
