Family Policy Alliance Files Amicus Brief in Kerr Case; Supports the Right of States to Block Medicaid Funding from Planned Parenthood

The Family Policy Alliance and State Family Policy Councils filed an amicus brief on Monday in the case of Kerr v. Planned Parenthood South Atlantic.

The Kerr case involves whether pro-life states like South Carolina can direct Medicaid funds away from abortion providers such as Planned Parenthood.

In June 2023, the U.S. Supreme Court vacated the Fourth Circuit decision in the case, ordering the appeals court to reconsider its ruling in light of the decision in Health and Hospital Corporation of Marion County v. Talevski.

The Kerr case addresses South Carolina’s determination that Planned Parenthood was not qualified to receive taxpayer funding as part of its Medicaid program, according to the amicus brief, led by the Independence Law Center, part of the Pennsylvania Family Policy Council.

Originally, a district court and the Fourth Circuit forced the state to restore Planned Parenthood’s funding. The Supreme Court later vacated the judgment, sending it back to the Fourth Circuit.

The Fourth Circuit again ruled in favor of Planned Parenthood. The Supreme Court is being petitioned to revisit the case. The amicus brief supports the petition and urges the Court to allow states to disqualify Medicaid providers that do not reflect the healthcare priorities of the individual states.
